Hi, my name is Tim, and i have just found this interesting site.
I used to use a metal detector many, many years ago. Then I had a long dormant period away from it. A few years ago I was interested in getting back to it, and decided to invest a few hard earned sheckles and update my existing, now ancient c scope detector, which was little more than a toy.
Being a responsible chap, and knowing the disdain that was cast over detectorists at the time, I decided to bring
myself up to speed on the current law(if any) in existence at the time. So I decided the chaps in charge of the monuments ect,ect, in Dublin at the time. before I risked my money, on a possible ilegal persuit.
To cut a long, long e mail communication short, I was made to feel like a criminal, was told that my equipment would be confiscated, and i could risk the full rigours of the law by owning a detector, never mind using it. I could not have it in the car, or on my person, as in Ireland I would never ever be more than 5 km from a heritage site...
So basically they made me belive I would be committing the most grevious of sins.
Needless to say, at the time, I did not need the hassle.
Perhaps this site is now rekindling a flickering ember

Thanks for the welcome. I just checked the archaeological site map to familiarise myself with my locality.
It appears i am slap bang in the middle of numerous dots , both red and blue. As many as 4 within 100 metres of my house . Ring forts, enclosures, ruins.
So basically my locale does not permit me to engage in my hobby, at the moment. Nothing like this to dampen your enthusiasm.
I,m off to educate myself further..

I presume this is the statute in question.
National Monuments (Amendment) Act, 1987
On a quick cursory look, it seems you are presumed guilty of something until you prove otherwise.
I know we live in a land whee we are governed by consent, but on first thoughts it seems a bit strange.

The important part timmy is understanding the words you only break the law when you do things that are not allowed. Like the presumed guilty part you would need to be on the site of a monument or protected area with a detector in hand. Now timmy why would you want to do such a thing? honestly sticking to the rules makes sense we just need to understand the wording. If we want a new improved system we need to lobby for the hobby a green light for change. Enjoy the forum!

If you went for a walk on those sites and you found an archeological object without a detector in hand (eyes only) you would not be breaking the law. One of the bigger issues is the problem that we have no set distance to stay away from those red dots. They like to play with words so they would say you cannot use a detector in the vicinity of a protected site. The NMI 101 of scare tactics keep it vague and nobody will dare take a chance now you start to see how they manipulate the public. Another thing to remember is placing a red dot on a map is effortless for the NMI they do it without even looking at the area in person. My understanding is of the several thousand sites recorded in Ireland less than 10% have been officially examined. I guess the real question is how good a job have the NMI done with taxpayers money when it comes to checking out those reported sites.

So timmy get to a beach!! Preferably a busy beach that’s had good numbers of people using it during the past number of years. Swing away, get acquainted with the detector again and watch for results. Trash will happen along with the decent finds. And you’re away! Keep it simple, go where you’ll have no issues and stay clear of your own area and any hint of an archaeological site.

Just checked my distance from 2 zones of notification in own area.
1 is a Rath due for notification in the next revision . I am 300 yards from the boundary of notification.
This rath has had extensive work done near it for farming buildings ect over the years.
2 is an enclosure that is due for the next revision. Its marked as non existent, and I am
150 yards from the boundary of notification, and you see only a clear field here, even from aerial views.
I have just rotovated a small section of my garden, which i do every year, and would be tempted to try my
new detector here, as i lost some classic car keys here years ago from my VW's when they were stored here
in the corner of the garden. What would you think??

What would you think?? The definition of Vicinity is difficult to interpret. But when it comes to a court of law. That vicinity will be whatever the judge determines and will not be in your favour. Stay well clear of any notifications, old, new or to be included. Regarding your keys, it will be great practice. You never know what else will pop up Oh, and a warm welcome to the forum
